Ethics and the Sarbanes-Oxley Act
The Sarbanes-Oxley Act mandates that the auditor of American companies, and those doing business in the United States, of specified size to identify "any material internal control weakness" or "significant deficiency," in verifying that management has sufficient operational command to produce reliable and compliant financial reports. It's main purpose is, of course to curb unethical business practices. As monumental as the impact of Sarbanes-Oxley will be on business in the United States, and perhaps the world, it is not capable of addressing and resolving the crisis in ethics within corporate America that has required such legislation to be developed and passed as law. Until the causes of unethical behavior are addressed and resolved, business in America cannot hope to bring about effective, lasting change to positively alter performance and reliability.
Unethical behavior in business is endemic today and is the sum-total of each company's leaders and employees and their moral fabric. The "corporate culture" in any company is defined by the people themselves. In most businesses and within most people, there is not an intentional twisting of moral principles. Thus, unconsciously unconstructive behavior can begin covertly - as petty selfishness, doubt or fear - manifesting as common business environs of negative "office politics," or deceitful accounting, business development, sales or marketing procedures. These choices rob corporations of their strength and potential and can, as current events have shown all too forcefully, be a corporation's demise.
Even the laws legislating ethical practices cannot be adhered to reliably until the causes within employees at all levels are removed.
